My employer is based in location A and I work for a client at location B.even my paystubs shows a fake address in location A.Repeated requests to change it to the correct address is of no avail. Can I get a H1 transfer and then go for visa stamping. My paystubs would still reflect the old employer. What is the best thing to do at this point? | | | Post Reply | | |

| | Date: | Tue 30 Jun 2009 06:01:47 PM EDT | | Subject: | Status is legal or not? H1B transfer with old paystubs with another petition pending? | | | Hi,
I was laid off by my previous company in March end, and I got my last pay-stub in April end including the separation package. I applied for transfer of my visa to another company in May start (They mentioned "mid may or later" as the probable joining date). I am still waiting for the petition approval, and also haven't yet got any confirmed joining date from my new employer. Is my status Legal in US right now? Further, if I want to transfer to another employer now, with my last pay-stub being at least 2 months old, what are the chances of the approval of my petition (considering that I stayed in US pending another transfer petition)? Please advise.
Thanks | | | Post Reply | Display replies to this message

I have a valid H1B visa stamped. I was in US till apr 30th, now due to my assignment completion, i had to come back. My visa is through a MNC, as you all know, how many rules and policies we have to come across for the so called "onsite" oppurtunity. I dont want my Visa to go waste/unused. Its valid till next year. My question, can my Visa be transferred while i am at India? I have paystubs of my US stay till april2009. Thanks for your suggesstions/answers in advance.

How is SAP ABAP Job market in USA now?
When is it expected to go up?
Will it be advisable to come there now and search for the project? Because every body shopper says that I have to be in US to search for a project.
But considering the current recession time, I am hesitant to travel there first and then search project.
Thanks for your valuable advice!

| | Date: | Fri 15 May 2009 03:07:39 AM EDT | | Subject: | HIB new rules | | | I am hired on H1B by a consulting firm. I do not have stamping yet. My consulting firm placed me in a project from last April and it lasted till 5th of May 2009.Now I am on bench. My consulting firm has suddenly called me up and said I cannot be on bench for more than 2 weeks , since new rules have come and in these times to get a project again in US may take 4-5 months so I should leave for India in few weeks time. They promised to send me documents, pay stubs and other paper work needed for multiple entry visa from US embassy in chennai, India. They also indicated the problems of payroll if I continue to be on bench in USA now. They advised me to re-enter USA after multiple entry visa and securing a project for my placement.
I want to understand what new rules by USIS have made these steps necessary? Is this genuine or am I being taken for a ride?
